House Rules

Harzträume · Sibylle Reinhardt · Benzingeröder Chaussee 72 · 38855 Wernigerode, Germany

1. House rules and fire safety

(1) These house rules form part of the terms and conditions. They apply throughout the stay. Guests show consideration for neighbours, residents and other guests. Quiet hours are from 10:00 pm to 7:00 am; avoidable noise must be avoided. This also applies outdoors.

(2) Smoking is strictly prohibited in all holiday apartments and shared indoor areas. The ban covers tobacco, cannabis, e-cigarettes, vaporisers, shisha and comparable smoking or vaping products.

(3) Open flames and the lighting or use of burning or smouldering objects are strictly prohibited in the holiday apartments and shared indoor areas. This applies in particular to candles, tea lights, incense cones, incense sticks and fuel pastes. Fireproof mats or suitable containers are no exception. Electric LED candles are allowed.

(4) Fireworks, table fireworks, sparklers and other pyrotechnic items may not be lit or used indoors. Outdoors, the statutory and official bans and safety distances apply; the other bans in these house rules remain in force.

(5) Outdoors, smoking is permitted only in designated places. Smoke must not enter the accommodation or unreasonably disturb other people. Cigarette remains must be fully extinguished and disposed of in the ashtrays provided, never smouldering in waste bins or on the ground.

(6) Open fires, fire baskets, fire bowls and burning candles and tea lights are also prohibited outdoors. The exception is proper barbecuing in expressly approved places with the grills provided. Sufficient safety distances must be kept; devices in operation must not be left unattended. Barbecuing may be prohibited in the event of official requirements or increased fire risk. Devices must be left safe and fully cooled after use.

(7) Smoke detectors and other safety equipment must not be removed, covered, switched off or tampered with. Escape and rescue routes must be kept clear. In case of fire, call the emergency number 112 and leave the danger area without putting yourself at risk.

2. Consequences of breaching the smoking ban and fire safety rules

(1) Breaches must be stopped immediately. The landlady may warn the guest and ask them to stop the behaviour in breach of contract at once.

(2) In the event of serious breaches or breaches repeated despite a warning, the landlady may terminate the contract without notice for good cause if, taking the individual case and both parties’ interests into account, she cannot reasonably be expected to continue it. A warning is not required if it would obviously be futile or if special reasons justify immediate termination. This may be the case where there is a considerable fire hazard or smoke detectors have been tampered with. After effective termination, the accommodation must be returned immediately.

(3) In the event of breaches for which the guest is responsible, the necessary and reasonable costs and provable damage caused must be reimbursed. These may include special cleaning, odour removal, textile and upholstery cleaning, repairs, necessary replacement taking age and condition into account, justified call-out costs and proven loss of rental income. Invoicing is transparent and documented; saved expenses and benefits to be credited are taken into account. The same damage is not charged more than once.

3. Further rules for your stay

(1) Departure and cleanliness: Used dishes must be left cleaned and put away, the fridge emptied and waste disposed of. Windows and doors must be closed. Appliances not intended for continuous operation must be switched off; keys and transponders must be returned as agreed. The usual final cleaning remains the landlady’s task. Departure notes explain these duties but do not extend them retroactively.

(2) Waste: Please observe the bins provided and the sorting instructions. Glass must be disposed of in public collection containers or at the collection point by the bins. Wet wipes, hygiene products, food waste, fats and oils do not belong in toilets or drains. Bulky items, large amounts of packaging and non-household waste may only be left behind by arrangement.

(3) Parking: Only the parking space assigned to you may be used. Additional vehicles and trailers require prior arrangement; an additional fee must be agreed in advance. Access roads, escape routes and other parking spaces must be kept clear.

(4) Outdoor areas: Only the seating and outdoor areas intended for guests may be used. Private areas of the residents and the owner’s family are excluded. The private playground at the apartments “Gute Stube” and “Speicher” at the Horstbergwarte is not part of the booked services. Children may use it by arrangement and only under the supervision of a responsible adult. The landlady does not provide supervision. Statutory liability and safety duties remain unaffected.

(5) Heating and ventilation: Rooms must be heated appropriately and ventilated briefly and thoroughly on a regular basis. Long periods of tilted windows and permanent cooling should be avoided. Any digital thermostats and window contacts may reduce heating when windows are open. After airing, windows must be closed completely. When drying laundry, take particular care to ventilate and heat sufficiently.

(6) Laundry: In “Gute Stube” and “Speicher”, washing machines and drying racks are available as described in the property description. In the Kommandantur building, the shared washing machine and dryer can be used by prior arrangement, as they are also needed for ongoing operations.

(7) Access: Guests’ privacy is respected. If there is a justified reason, such as necessary repairs or concrete signs of considerable damage, any necessary access will be announced beforehand and agreed with the guest. No unilateral checks are carried out on the basis of general suspicion. In an acute emergency, access without prior agreement may be necessary; statutory requirements remain decisive.

4. Wi-Fi and Smart TV

(1) The Wi-Fi provided may be used lawfully by the booked guests during their stay. Unlawful use, in particular copyright infringement, is prohibited. Access data may not be passed on to unauthorised third parties.

(2) A specific transmission speed is only owed if it has been expressly promised. Technical faults may occur. Agreed features and statutory rights in case of defects remain unaffected. Where there are concrete indications of misuse, access may be restricted to the extent necessary and proportionate.

(3) Personal streaming accounts may be used to the extent technically available. Guests should log out of all accounts before departure and delete saved login details. Guests bear the costs of personal subscriptions and purchases.
