1. Scope and contract

These terms apply to the rental of our holiday apartments at Westernstraße 38a and Benzingeröder Chaussee 72 in Wernigerode. The contracting party is Sibylle Reinhardt.

The contract is concluded with our booking confirmation. It becomes valid when the deposit or the full payment has been received in the landlady’s account. For bookings made through Airbnb, Booking.com or other portals, the portal’s terms apply in addition; the payment and cancellation rules agreed there take precedence. The person booking must be of legal age and passes these terms and the house rules on to their fellow travellers.

2. Prices and payment

The prices stated at booking apply, including VAT. Final cleaning is included in the stated price; the tourist tax is charged separately. We do not charge a security deposit.

Flexible rate: 50 % at booking (credit card immediately, bank transfer within 5 days), the remaining 50 % no later than 28 days before arrival. For bookings made 28 days or less before arrival, the full amount is due immediately.
Non-refundable rate: The full amount is due at booking.

If payment is not made despite a reminder and a reasonable grace period, this is treated as withdrawal from the contract. We may then re-let the apartment; the cancellation rules (section 5) still apply.

We do not charge extra for water, electricity, parking, waste and internet, as long as consumption is not disproportionately high.

3. Tourist tax and guest card

The tourist tax follows the rules of the city of Wernigerode and is charged with the final payment or can be paid on site. If a stay is cancelled or not taken up, we refund any tourist tax already paid. For the guest card and the registration we need the details of all guests, which you can conveniently enter in the online check-in.

4. Arrival and departure

Arrival from 3:00 pm, departure by 10:00 am. Earlier check-in or later check-out is possible by arrangement and may cost extra. If you depart more than 2 hours late, we charge for an additional night.
You will receive the access details for self check-in in good time before arrival. Please do not pass them on to third parties.
Please keep keys and codes safe. If anything is lost, report it immediately; you bear the necessary replacement costs if you are responsible for the loss.

5. Cancellation

Please cancel by email. What counts is receipt by us; the day of arrival is not counted.

A mere cancellation is free of charge within the period stated. If the booking is changed to other dates instead, we charge a processing fee of €35; the rebooked reservation can then no longer be cancelled free of charge.

The tourist tax is not included. You may always prove that we suffered a lower loss. We will try to re-let the apartment; income from this is credited. If you arrive later or leave earlier, we do not refund pro rata. We recommend travel cancellation insurance.

6. Occupancy, use and pets

The apartment may only be occupied by the number of guests booked. Subletting and passing the apartment on to third parties are not permitted.
Parties and celebrations are not permitted. Commercial photo or film shoots are only possible with our prior consent.
Pets are not permitted, including assistance dogs.
Please treat the apartment and furnishings with care and report defects or damage immediately so that we can help quickly.
The current house rules apply (house rules on our website). If they are not observed, we may ask guests to leave.

7. Liability

You and your fellow travellers are fully liable for damage caused through fault. For valuables brought along and parked vehicles, we are liable only within the limits of statutory provisions.

In cases of intent, gross negligence and injury to life, body or health, we are liable in accordance with the statutory provisions. If we cannot provide the accommodation due to unforeseeable circumstances beyond our control, the statutory provisions on refunds apply.

8. Final provisions

German law applies. Place of jurisdiction and place of performance is the landlady’s place of residence, insofar as legally permissible. Information on data protection can be found in our privacy policy at www.harztraeume.de/datenschutzerklaerung/.

Photos and texts on the website serve as a realistic description; a 100 per cent match with the accommodation cannot be guaranteed. We reserve the right to change furnishings (e.g. furniture), provided they are of equal value.

If any provision is invalid, the remainder stays valid. Agreements in text form (e.g. email) are sufficient.
